Chapter 41, POLICE

ARTICLE I, Auxiliary Police Force [Adopted 8-9-1982]
§ 41-1. Establishment.
An auxiliary police force is hereby established as hereinafter set forth.
§ 41-2. Authority of County Sheriff to appoint officers.
The County Sheriff is hereby authorized to appoint auxiliary police officers as he deems necessary, not to exceed the number of regular full-time deputies authorized for his department.
§ 41-3. Rules and regulations.
The County Sheriff, with the approval of the Board of Supervisors, shall establish rules and regulations concerning the operation of the auxiliary police force, including their uniforms, arms and equipment and training.
§ 41-4. Qualifications for appointment; revocation of appointment.
Persons appointed to the auxiliary police force shall be of good character. Their appointment shall be revocable at any time by the Sheriff or upon a majority vote of the Board of Supervisors.
§ 41-5. When auxiliary force to be called into service. [EN]2
The auxiliary police force may be called into service as deemed necessary by the Sheriff or, such as in times of public emergencies, when requested by the County Director of Emergency Services. Said force may also be called into service at such times as there are insufficient numbers of regular Sheriff deputies to preserve the peace, safety and good order of the county and at any time for the purpose of training.
§ 41-6. Wearing of uniforms; powers.
When called into service, the auxiliary police shall wear the prescribed uniform and shall have all the powers and authority and all the immunities of constables at common law.
§ 41-7. Compensation; fundraising activities.
Persons appointed to the auxiliary police force shall serve without compensation. The force may be permitted to conduct certain fundraising activities for the mutual benefit of said force.
ARTICLE II, Emergency Services [Adopted at time of adoption of Code [EN]1
§ 41-8. Adoption of Plan.
Pursuant to § 44-146.19 of the Code of Virginia, the Board of Supervisors hereby adopts the Shenandoah County Emergency Operations Plan, dated April 26, 1994, as the official plan for county emergency services. Such plan may be amended periodically as needed by resolution of the Board of Supervisors.
§ 41-9. Designation of Director of Emergency Services.
Pursuant to § 44-146.19 of the Code of Virginia, the Chairman of the Board of Supervisors shall be the Director of Emergency Services; provided, however, that the Board of Supervisors may by resolution delegate the duties of the Director of Emergency Services to an employee of the Office of County Administration. It shall be the duty of the Director of Emergency Services to direct the implementation of the county's Emergency Operations Plan.
§ 41-10. Designation of Emergency Services Coordinator and Hazardous Materials Coordinator.
A. Pursuant to § 44-146.19 of the Code of Virginia, the Director of Emergency Services shall appoint a coordinator of emergency services. Such Emergency Services Coordinator shall be the Director of the Emergency Operations Center, and the Deputy Emergency Services Coordinator shall be the Fire Marshal, unless the Director of Emergency Services specifically appoints other persons to these positions.
B. Pursuant to § 44-146.38 of the Code of Virginia, the Director of Emergency Services shall appoint a coordinator of hazardous materials. Such Hazardous Materials Coordinator shall be the Fire Marshal, and the Deputy Hazardous Materials Coordinator shall be the Director of the Emergency Operations Center, unless the Director of Emergency Services specifically appoints other persons to these positions.
